All content on this Website — including but not limited to text, photography, videos, illustrations, graphics, the Moi Doughssier® wordmark, icon, character designs (including all Moi Ville characters), and the overall visual identity — is the exclusive intellectual property of Zonafi Ventures (OPC) Private Limited, protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable Indian and international intellectual property laws.

You may not:

• Reproduce, republish, distribute, or publicly display any content from this Website without prior written permission from Zonafi Ventures (OPC) Private Limited.
• Use the Moi Doughssier® trademark, logo, or any confusingly similar mark in any context — commercial or otherwise — without our written consent.

All products displayed on the Website are subject to availability. Moi Doughssier products are handcrafted in small batches daily. We reserve the right to withdraw, modify, or discontinue any product without notice.

Product photographs are for illustrative purposes. Due to the handcrafted nature of our products, minor variations in appearance are inherent and do not constitute a defect.

Certain items — particularly bomboloni, viennoiserie, and limited seasonal products — may sell out on any given day. We do not guarantee the availability of any specific item.

5. Ordering Channels

5.1 Direct Website Ordering (via Ciferon)

Orders placed through our website are processed via Ciferon, our integrated online ordering partner. By placing an order through Ciferon, you agree to Ciferon's own terms and conditions in addition to ours. You confirm that the information provided is accurate, you are at least 18 years of age (or have parental consent), and you accept these Terms.

5.2 Swiggy and Zomato

Orders placed through Swiggy (Bundl Technologies Private Limited) or Zomato (Eternal Limited) are governed by their respective terms and conditions. Moi Doughssier is responsible only for the preparation of your order. All delivery, payment, cancellation, and refund matters relating to those platforms are governed by their own policies.

5.3 WhatsApp Orders

We accept enquiries and orders for custom cakes, corporate gifting, and other special orders via WhatsApp. These are agreed directly between you and us and are governed by these Terms to the extent applicable. A written confirmation via WhatsApp constitutes a valid order.

5.4 Custom Cake and Corporate Gifting Orders

Custom celebration cakes and corporate gifting hampers are bespoke products requiring advance notice and confirmation. Please refer to our Cancellation and Refund Policy for terms specific to these orders.

6. Pricing, GST, and Payment

All prices on the Website are listed in Indian Rupees (INR). Prices include Goods and Services Tax (GST) at the applicable rate (currently 5% for restaurant and bakery items). Prices are subject to change without notice. The price applicable to your order is that confirmed at the time of order acceptance.

Payments for website orders are processed through Ciferon's secure payment gateway. We do not collect, store, or process card details on our own servers.

For WhatsApp and custom orders, payment terms will be communicated at the time of confirmation and may include advance payment requirements.

7. Collection, Delivery and Liability

Self-collection is strongly recommended for all orders, and particularly for custom cakes, corporate hampers, and fragile items. Our products are prepared and packaged with care, and we take full responsibility for their condition while they are on our premises.

Our responsibility ends at the point of handover from our kitchen — whether that is at our counter for self-collection, or to a delivery agent for arranged delivery. Once an order has left our premises in good condition, Zonafi Ventures (OPC) Private Limited and the Moi Doughssier® brand accept no liability for:

• Any damage, deterioration, spillage, or loss that occurs during transit
• Changes in product condition due to temperature, handling, or delays by the delivery agent
• Non-delivery or late delivery caused by the delivery agent or circumstances beyond our control
• Any consequential loss arising from the above

Arranged delivery: If you request delivery, we will arrange it on your behalf at actual cost, charged to you. In doing so, the delivery agent acts as your agent — not ours. Any claim arising from the condition of the product upon arrival must be directed to the delivery service. We will document the condition of all orders at the point of dispatch, and this documentation shall serve as conclusive evidence of the product's condition upon leaving our kitchen.

Delivery through Swiggy and Zomato is governed entirely by those platforms' own terms, delivery policies, and refund processes. Please raise any delivery concerns through the respective platform app.

Indemnification: By placing an order with arranged delivery, you agree to indemnify and hold harmless Zonafi Ventures (OPC) Private Limited and its representatives from any claims, losses, or damages arising from the condition or non-delivery of products after they have left our premises.

8. Allergen and Dietary Information

Our kitchen handles common allergens including gluten, dairy, eggs, tree nuts, peanuts, and soy. While we take reasonable precautions, we cannot guarantee that any product is entirely free from allergen cross-contamination. If you have a severe allergy, dietary restriction, or medical condition, please contact us directly before placing an order. We will make our best efforts to accommodate your needs, but cannot guarantee a fully allergen-free environment.

9. User-Generated Content

9.1 Moi Moment Feature

Our Website includes a "Moi Moment" feature that allows you to upload a photograph to create a personalised digital postcard. By uploading an image:

• You confirm that you own the rights to the image or have permission to use it.
• Your image is processed entirely within your browser and is not uploaded to or stored on our servers.
• You are solely responsible for the content of any image you upload.
• You agree not to upload images that are offensive, defamatory, illegal, or infringe any third party's rights.

9.2 Postcard Feature

The "Send a Treat" postcard feature allows you to generate a digital postcard for sharing via WhatsApp or other platforms. The postcard is generated locally on your device. We are not responsible for how such postcards are used or distributed once they leave our Website.

10. Interactive Features — Games and Leaderboard

Our Website includes interactive game features ("Moi Ville" games). By participating:

• You agree to provide a display name that is appropriate and does not impersonate others or include offensive content. We reserve the right to remove any display name we deem inappropriate.
• Your display name and score are stored on our backend database (Supabase) and may be displayed publicly on the leaderboard.
• We do not guarantee the accuracy, continuity, or availability of leaderboard data.
• The games are provided for entertainment purposes only. We make no representations about prizes, rewards, or competition outcomes unless explicitly stated.

11. WhatsApp Communication

By initiating contact with us via WhatsApp, you consent to receiving responses, order confirmations, and relevant communications from Moi Doughssier through that channel. We do not send unsolicited marketing messages via WhatsApp. You may opt out of further communication at any time by letting us know.

12. Third-Party Links and Services

Our Website contains links to third-party websites and services including Swiggy, Zomato, Ciferon, and our social media profiles. These links are provided for convenience only. We have no control over the content, availability, or practices of third-party websites and accept no responsibility for them. Your use of third-party services is governed by their respective terms and conditions.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Zonafi Ventures (OPC) Private Limited shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or our products.
• Loss of profits, revenue, data, or goodwill.
• Damages arising from delays, errors, or omissions by third-party platforms (Swiggy, Zomato, Ciferon).
• Disruption or unavailability of the Website for any reason.

Our total liability for any claim arising out of or related to these Terms or your use of our products shall not exceed the value of the specific order to which the claim relates.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

14. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemic or pandemic, civil unrest, government restrictions, power failures, internet service disruptions, or failure of third-party suppliers. In such circumstances, we will notify you as soon as reasonably practicable and work to resume normal operations.
